Agreement to Terms

By accessing or using the RythmRun mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the service.

Description of Service

RythmRun is a fitness tracking application that allows users to:

• Record and track fitness activities (running, walking, cycling, etc.)
• Share fitness activities with friends
• Connect with other users
• Monitor fitness progress over time

User Accounts

Account Creation

• You must create an account to use the App
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must be at least 13 years of age to create an account

Account Security

• You are responsible for all activities under your account
• You must keep your password secure
• You must immediately notify us of any unauthorized use
• We reserve the right to suspend accounts that violate these Terms

Acceptable Use

You Agree To:

• Use the App only for lawful purposes
• Provide accurate and truthful information
• Respect other users’ privacy and rights
• Not impersonate any person or entity
• Not interfere with the App’s security features
• Not use automated systems to access the App
• Not attempt to reverse engineer or hack the App
• Not post offensive, abusive, or inappropriate content

Prohibited Activities

You may NOT:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, threaten, or abuse other users
• Post spam, advertisements, or solicitations
• Spread malware or viruses
• Attempt to gain unauthorized access to the App
• Collect user data without consent

Fitness Activities and Location Data

Activity Responsibility

• You are solely responsible for your safety during activities
• The App does not guarantee the accuracy of GPS or location data
• Always exercise outdoors safely and follow traffic laws
• The App is not responsible for any injuries or accidents
• Consult a doctor before beginning any exercise program

Location Data

• The App collects location data when you track activities
• Location data is used solely for fitness tracking
• You can disable location tracking in settings
• We take reasonable measures to protect your location privacy

Intellectual Property

Our Rights

• All App content, features, and functionality are owned by RythmRun
• Our trademarks and logos are our exclusive property
• The App and its code are protected by copyright and trade secret laws

Your Rights

• You retain ownership of content you create (activities, comments, photos)
• By posting content, you grant us a license to display it in the App
• You can delete your content at any time
• Deleted content may take up to 30 days to remove fully

Privacy

Your privacy is important to us. Our Privacy Policy governs how we collect, use, and protect your information. By using the App, you also agree to our Privacy Policy.

Termination

We May Terminate Your Access If:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You harm or threaten other users
• We discontinue the service

You May Delete Your Account:

• At any time through app settings
• By contacting support
• This will remove your personal data per our Privacy Policy

Disclaimers

Service Availability

• The App is provided “as is” and “as available”
• We do not guarantee uninterrupted or error-free service
• Service may be modified, suspended, or discontinued at any time
• We are not liable for service interruptions or technical issues

Fitness Tracking Accuracy

• GPS and fitness data are estimates only
• Distance, pace, and calories are approximations
• Actual results may vary
• Always verify critical measurements independently

Health Disclaimer

• The App is for informational purposes only
• It is not a substitute for professional medical advice
• Consult healthcare professionals before starting any fitness program
• We are not liable for any injuries or health issues

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• RythmRun and its operators are not liable for any damages
• We are not liable for personal injury, death, or property damage
• We are not liable for data loss or security breaches
• Total liability shall not exceed the amount you paid to us (if any)

Indemnification

You agree to indemnify, defend, and hold harmless RythmRun and its operators from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App. Continued use of the App after changes constitutes acceptance of the new Terms.

Third-Party Services

The App may use or display third-party services (maps, analytics, etc.). We are not responsible for third-party services, their content, or their privacy practices.

Dispute Resolution

Governing Law

These Terms are governed by the laws of [INDIA], without regard to conflict of law principles.

Dispute Process

1. Contact us first to resolve any disputes
2. If unresolved, disputes may be subject to arbitration

International Users

Account Deletion

Upon Account Deletion:

• Your personal data will be deleted per our Privacy Policy
• Your posts and activities will be removed from public view
• Backup data may be retained for disaster recovery
• Some data may be anonymized for analytics

Force Majeure

We are not liable for failures due to circumstances beyond our control, including natural disasters, government actions, war, pandemics, or technical failures.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms constitute the entire agreement between you and RythmRun regarding the App and supersede all prior agreements.
